Agreement to Terms
By downloading, installing, or using the Earn It application ("App," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Earn It ("Company," "we," "us," "our"). These Terms apply to all users of the Service.
Description of Service
Earn It is an iOS application that uses Apple's FamilyControls and Screen Time frameworks to temporarily restrict access to selected applications on your device. Access is restored when a user completes a verified healthy habit, which may include:
- Push-ups (verified via on-device camera and AI pose detection)
- Squats (verified via on-device camera and AI pose detection)
- Walking / step goals (verified via Apple Health integration)
- Touching grass / being outdoors (verified via photo submission to AI service)
The Service is designed for personal wellness and productivity use. It is not a parental control tool and is intended for users who voluntarily wish to manage their own screen time.
Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent that you are 13 or older. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
The App is available on iPhone and iPad devices running iOS 16.0 or later. A compatible device and internet connection are required for certain features (subscription management, Touch Grass verification).
Subscriptions and Billing
Earn It offers the following subscription plans, processed through Apple's App Store and StoreKit:
- Monthly Plan: $9.99 USD per month, billed monthly on your subscription renewal date.
- Annual Plan: $39.99 USD per year (equivalent to $3.33/month), billed annually on your subscription renewal date.
Free Trial: New subscribers may be eligible for a 7-day free trial. The trial automatically converts to a paid subscription unless cancelled at least 24 hours before the trial period ends.
Billing: Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period; no refunds are issued for partial periods.
Price changes: We reserve the right to change subscription prices with reasonable notice. Price changes will apply at the start of the next subscription period following the date of the change.
Apple Standard EULA
In addition to these Terms, your use of the App is also governed by Apple's Standard End User License Agreement (EULA) for App Store applications, available at apple.com/legal/internet-services/itunes/dev/stdeula. In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall govern with respect to the use of the App.
Apple is not responsible for the App or its contents. All claims related to the App (including product liability, legal compliance, or consumer protection) are the sole responsibility of Earn It.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any regulations.
- Attempt to bypass, circumvent, or disable any App functionality.
- Reverse engineer, decompile, or disassemble any portion of the App.
- Use the App in a manner that could damage, disable, or impair the Service.
- Submit false or misleading verification data (e.g., submitting pre-existing photos for Touch Grass verification).
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content within the App.
The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. Consult a healthcare professional before beginning any exercise program.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EARN IT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10.00 USD.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.
Intellectual Property
The App and its original content, features, and functionality are and will remain the exclusive property of Earn It. The App is protected by copyright, trademark, and other applicable laws. You may not use our trademarks or trade dress without our prior written consent.
Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions that should survive termination (including ownership provisions, warranty disclaimers, and limitations of liability) shall survive.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.
